Offence

It is an offence to drive or attempt to drive a vehicle whilst unfit through drink or drugs.   The procedure is similar to that of a standard drink driving offence,however, when unfit through drugs a blood sample can be tested as well as urine.   Additionally the police will be looking for evidence to show that your driving was impaired and will rely on both medical evidence and the standard of your driving  - such as being involved in an accident.

Punishment

The Court has power to impose imprisonment of up to 6 months or impose a fine of up to £5,000 and a minimum disqualification of 12 months.

If you have been convicted of a similar matter within the preceding 10 years, then the disqualification will be increased to a minimum of 3 years and any punishment may be more severe.
